I, the participant, certify and assure that my Dog(s) is/are current with all vaccinations, including Rabies, is/are in good health, is/are able to tolerate the presence of crowds and other dogs, and has/have not exhibited aggressive behavior toward persons or other dogs, nor caused injury to a person or another dog. I agree to abide by all the rules and instructions given in connection with the events hosted by the Northwest Michigan Golden Retriever Club.

I understand that there are certain risks to attending these events that the Northwest Michigan Golden Retriever Club and its shareholders, directors, officers, employees, partners, affiliates, agents, and successors, as well as event organizers, sponsors, vendors, and volunteers (“Released Parties”) cannot eliminate, including the risk of contracting illness, such as COVID-19, risk of harm or injury from other attendees and/or their dogs, risk of property damage, bodily injury, permanent disability, and possible death. HAVING KNOWLEDGE OF THESE DANGERS, I VOLUNTARILY TAKE RESPONSIBILITY FOR ALL RISKS OF ATTENDING THE EVENTS IN 2024.

In exchange for being admitted to these events, I, for myself and on behalf of my heirs, representatives, and assigns, release and hold harmless the Released Parties from all legal and financial responsibility and agree not to sue for any harm or injury of any nature (including economic loss, illness, injury, disability, or death) that I, any minor(s) accompanying me, my dog(s), or personal property might suffer during or as a result of our attendance, even if the harm is caused by the negligence of the Released Parties.

To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from any claims, losses, damage, assessments, fines, expenses, costs, legal fees, and causes of action or penalties that the Released Parties have to pay for any claim for loss or injury arising out of or resulting from the actions or omissions of me, accompanying minor(s), or my dog(s) at these events; provided, however, that nothing in this Release shall be understood to provide for indemnity of the Released Parties for their sole gross negligence or willful misconduct.

I expressly consent to the Northwest Michigan Golden Retriever Club and its agents using the name, picture, and likeness of me, accompanying minor(s), and/or my dog(s) as recorded during these events in 2024 for promotional purposes. I authorize the Northwest Michigan Golden Retriever Club and its agents to use, reproduce, exhibit, or distribute the name and likeness of me, accompanying minor(s), and/or my dog(s) for this purpose in any communication medium currently existing or later created, including print media, television, and social media platforms.

I, for myself and on behalf of my heirs, representatives, and assigns, release and hold harmless the Released Parties, from liability for any appropriation of likeness or use of the name or likeness of me, accompanying minor(s), and/or my dog(s) for the purposes and communication media described above. I understand that all recordings of the name, picture, and likeness, in whatever medium, of me, accompanying minor(s), and/or my dog(s) shall remain the property of the Northwest Michigan Golden Retriever Club.

By signing this waiver, I expressly acknowledge that an inherent risk of exposure to COVID-19 exists in any public place where people are present. By attending the events hosted by the Northwest Michigan Golden Retriever Club in 2024, I voluntarily assume all risks related to exposure to COVID-19 and agree not to hold the Northwest Michigan Golden Retriever Club or any of their affiliates, attendees, sponsors, vendors, or volunteers liable for any illness, injury, or other harm that may occur, even if caused by the negligence of the Released Parties.

I UNDERSTAND THAT BY SIGNING THIS RELEASE, I AM GIVING UP MY LEGAL RIGHT TO SUE THE RELEASED PARTIES AND/OR TO SEEK COMPENSATION FROM THEM FOR ANY INJURIES OR DAMAGES THAT I, ACCOMPANYING MINOR(S), OR MY DOG(S) MAY INCUR AS A RESULT OF, INCIDENT TO, OR IN CONNECTION WITH PARTICIPATION IN THE EVENTS HOSTED BY THE NORTHWEST MICHIGAN GOLDEN RETRIEVER CLUB OR ANY USE AND/OR PUBLICATION OF OUR NAMES, LIKENESSES, IMAGES, VOICES, RECORDINGS, BIOGRAPHICAL INFORMATION, AND/OR OTHER IDENTIFICATION BY ANY OR ALL THE RELEASED PARTIES.

I have read, understand, and agree to all the terms in this Release and Waiver of Liability and Indemnity Agreement and am submitting this entry on my own behalf, on behalf of my guests, and on behalf of the accompanying minor(s).
